These Terms & Conditions ("Terms") govern access to and use of Kaizen CRM (the "Service"), provided by Kaizen Financial LLC, doing business as Kaizen CRM ("Kaizen," "we," "us," or "our"). By purchasing, accessing, or using the Service, you ("Customer," "you") agree to be bound by these Terms.
Kaizen CRM is a customer relationship management and lead follow-up automation platform built on the GoHighLevel platform, designed for licensed insurance agents. The Service includes automated texting, calling, email follow-up, appointment scheduling, and related pipeline management tools.
You must be at least 18 years old and hold any applicable insurance licenses required in your jurisdiction to use the Service for its intended purpose. You are responsible for the accuracy of the information provided during signup and for maintaining the confidentiality of your account credentials.
Access to the Service is billed on a subscription basis and processed securely through Stripe. By subscribing, you authorize Kaizen to charge your payment method on a recurring basis until you cancel. Prices are subject to change with reasonable advance notice to active subscribers.
Use of texting features requires completion of Application-to-Person (A2P) 10DLC registration with the relevant carriers. Kaizen provides onboarding guidance, including a Loom walkthrough and step-by-step documentation, to assist with this process. You are responsible for the accuracy of information submitted during A2P registration.
You agree to use the Service in compliance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, applicable state insurance marketing regulations, and all carrier-level 10DLC messaging requirements. You are solely responsible for obtaining proper consent from your leads and clients before contacting them through the Service. Kaizen provides compliance controls but does not guarantee compliance with laws applicable to your specific use of the Service.
You agree not to use the Service to send unsolicited messages in violation of applicable law, to misrepresent your identity or licensing status, or to use the Service for any purpose other than legitimate insurance sales and client communication activity.
You retain ownership of your client and lead data entered into the Service. Kaizen's handling of that data is described in our Privacy Policy. You are responsible for ensuring you have the right to store and process any client data you upload.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Kaizen does not provide refunds for partial billing periods except where required by law.
The Service is provided "as is" without warranties of any kind. Kaizen does not guarantee any specific sales results, lead conversion rates, or income outcomes from use of the Service. Any figures referenced in marketing materials are illustrative and will vary based on lead quality, lead source, and individual performance.
To the maximum extent permitted by law, Kaizen Financial LLC shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to lost profits or lost business opportunities.
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
